Thereby, based on the regulations implementing the Environmental Permit (GPMT) and the actual situation of businesses (facilities), there will be two specific cases:
Case 1: The facility has no changes compared to the previously approved environmental profile;
Case 2: The facility has changed some information compared to the previously approved environmental profile such as:
Increase the scale and capacity of the project but not to the point where approval procedures for adjusting investment policies are required;
Changing the project’s production technology generates waste but does not exceed the treatment capacity of existing environmental protection works;
Change the project’s waste treatment technology but is unlikely to have a negative impact on the environment;
Changing the location of the project but still consistent with the functional zoning planning of the concentrated production, business, service area or industrial cluster approved by the competent authority;
And other changes have been approved by the authorities.
LEGAL DOCUMENTS ENTERPRISES NEED TO PREPARE BEFORE IMPLEMENTING AN ENVIRONMENTAL PERMIT:
– Legal documents:
Latest business registration certificate;
Latest investment certificate;
Land lease contract/Certificate of land use rights;
A copy of the environmental impact assessment report (except for projects approved according to the provisions of the Law on Environmental Protection) and a copy of the decision approving the results of appraisal of the project’s environmental impact assessment report, or equivalent environmental records; component environmental licenses (if any).
– Technical drawings related to the project:
Overall as-built drawing of the project construction for completed works (fully showing all constructed work items such as factories, auxiliary houses, system of collection pipes and rainwater drainage, pipes to collect and drain production wastewater – domestic wastewater,…);
As-built drawing of the wastewater treatment system; dust, exhaust gas, and chemical vapor treatment system;
As-built drawing of fire prevention and fighting system.
– Documents related to handover and acceptance of environmental protection works:
Minutes of project handover/acceptance and putting into use for technical infrastructure items at the factory (rainwater drainage system, wastewater drainage system, factory, wastewater treatment system);
Note that this record must have the signature + seal of the Investor, Construction Unit, Design Unit and Supervision Consulting Unit)
Minutes of handover/acceptance of equipment installation and putting into use of the wastewater, dust and exhaust gas treatment system;
Diagram of sampling locations of the environmental monitoring program;
– Environmental monitoring results sheets at the facility;
– Monitoring results sheet for 2 consecutive years.
For example: If a business conducts environmental clearance in 2024, it needs a monitoring results sheet for 2022 and 2023.

In case an enterprise is subject to monitoring but does not have a monitoring result sheet, additional samples need to be collected as prescribed in Article 20 of Circular 02/2022/TT-BTNMT on Additional waste monitoring for establishments operating when applying for an environmental permit.
